A man was ordered to pay €8,176.5 (Lm3,510) in damages to the children of a deceased elderly woman whom he ran over on the 19th of May 1998.
The Gozo Court, presided over by Magistrate Anthony Ellul, found the driver, Saviour Mifsud, and the victim, Maria Conti, equally guilty to causing the traffic accident, and thus ordered Mifsud to pay for half the damages.
Magistrate Ellul held that Mr Mifsud was not driving carefully enough in order to prevent the accident. He also noted that Mrs Conti was not crossing the street on a pedestrian crossing which was situated nearby. As a result, both Mrs Conti and Mr Mifsud were found by the court to be equally responsible for the fatal accident.
The woman’s children had sued Mifsud for damages, stating that he was entirely responsible for causing the accident which took place in Fortunato Mizzi Street, Victoria.
