A company filed a judicial protest yesterday claiming damages after the adjudication of a tender for work at the abattoir in Gozo was halted because the adjudicating board had acted beyond its jurisdiction.
Camray Company Limited filed the writ against the Gozo Minister, the projects and development director within the Gozo Ministry and the director general of the Contracts Department.
The company is claiming damages since it said that it incurred expenses and lost business opportunities during the tendering process.
According to the writ, following a call for tenders issued by the Contracts Department on behalf of the Gozo Ministry, on 23 February 2005 Camray Company Limited, in partnership with an Italian company, Technostar Due Srl, submitted its tender to carry out work at the abattoir.
In the judicial protest, the company’s directors said that according to the Public Contracts Appeals Board, the adjudicating board had acted beyond the limits of its jurisdiction by asking the company to make changes to its offer.
The tender process was ultimately cancelled by the Public Contracts Appeals Board.
The company is suing for damages it sustained. Moreover, the directors said that the company’s competitiveness has been compromised because their competitors have information about their offer.
Dr Michael Sciriha and Dr Franco Galea signed the writ.
